Co. when he developed this grinder, and he left Geisler, apparently with their blessing, to begin manufacture of this grinder. Landis subsequently patented several improvements to his original design, and his line of grinders was very successful. |

The patent documents misspell the inventor's surname as "Cary". Subsequent litigation consistently spell his name as shown here. The inventor had been employed as a draftsman by Ingle Machine Co., and that company used his invention before the patent was applied for. The company went bankrupt and the assets were sold to Landis Tool Co., and those assets included drawings for Carey's invention, and presumably would have included the "shop right" to use the invention. But Carey's employment contract with Ingle Machine Co. did not explicitly assign them the rights to any inventions. After the bankruptcy Carey applied for the patent and Arthur Ingle was the assignee. Meanwhile, Landis hired Gurney Electric Elevator Co. to manufacture boring machines of Carey's design. Ingle sued for patent infringement. Landis claimed absolute title to the patent and demanded that the patent be turned over to them. Landis won but, on appeal, Ingle not only won the title to the patent but Landis, having failed to claim shop right to the invention, lost the right to manufacture the drilling machine and had to pay for infringing the patent. |
