The Harig Air-Flo Fixture, a surface-grinder accessory for sharpening end mills and other milling cutters, used this patented air bearing. This fixture provided the sensitivity needed to sharpen very small cutters, as small as 1/32 inch diameter. In United States District Court, Northern District of Illinois, Harig Products, Inc. v. K. O. Lee Co., claim 3 of this patent was held to be invalid. Harig appealed to the Seventh Circuit Court of Appeals, and lost again. These rulings seem somewhat surprising because although each individual element was not new—as is true for most patents—the combination was new. But the courts ruled that the combination was obvious to someone skilled in the art even though no-one had thought to combine them before this invention. |
