This patent was the subject of litigation. Its licensee, James Clark, Jr. Electric Co., sued United States Electrical Tool Co. for infringement but lost because "the alleged infringing device was in public use more than two years before application for the patent was filed." In Willey's design the drill chuck is driven by shaft turned by reduction gearings. The lawsuit was not filed until a decade after the patent was issued and 14 years after the designer of the alleged infringing product, had created has first version of it using the same reduction-gear-driven chuck. This delay created a hardship for the defense and the court took that hardship into account when assessing the quality of the evidence presented. |
